Oaxaca Congress approves advance of recall referendum; seeks to streamline procedures

The Oaxaca Congress approved a series of reforms to the State’s Political Constitution and the Law on Recall of Mandates for the State of Oaxaca, related to the organization, procedural deadlines, and implementation of the recall referendum.

With these modifications, it was established that the referendum will now begin during the month following the end of the third year of the Constitutional period; that the signature collection process may be carried out during the month prior to the recall request and will proceed at the request of citizens in an equivalent number, at least 10% of those registered on the Nominal Voter List, provided that the request corresponds to at least half plus one of the municipalities and represents at least 10 percent of the nominal list of voters in each of them.
Likewise, it stipulates that the Oaxaca State Electoral and Citizen Participation Institute (IEEPCO) will issue the authorized forms in print and electronic media during the first 10 days of October.

“It will provide detailed information on the minimum number of supporting signatures required and each of the variants that must be met for the request to be accepted, in accordance with Article 7 of the aforementioned regulation.”

Meanwhile, the verification periods for the names of those who have signed the revocation petition and the required percentages will be carried out within 10 calendar days, counted from the date the request for revocation of mandate is submitted.

The call for voting will be issued within three days. The voting date will be held on the Sunday following the 30th day after the call for voting is issued.

There were also changes to the question addressed in the process, to make it clearer, more accessible, and understandable.

According to the ruling, approved by 33 votes in favor and four against, the aim is to streamline procedures and make them accessible to citizens, “with the purpose of strengthening legal security, guaranteeing the certainty of the law, and facilitating access to citizen participation mechanisms.”

The amendments were made to the first paragraph of subsection a), the first and second paragraphs of subsection b), the first paragraph of subsection c); a third and fourth paragraph were added to subsection b), and the second paragraph of subsection a) of Article 25, Section C, Section III of the Political Constitution of Oaxaca was repealed.
