To strengthen cultural ties with the migrant community, Representative Javier Casique Zárate, a member of the Institutional Revolutionary Party (PRI), presented a Reform Initiative to the State Congress proposing to formally recognize as Oaxacan citizens those born abroad to Oaxacan parents.
According to the Draft Decree, this amendment seeks to grant legal certainty and equality to those who, through their lineage, maintain a direct link to their communities of origin. The legislator pointed out that place of birth should not be a criterion for exclusion when a legitimate legal and familial bond exists with the state.
In his statement of purpose, Representative Casique Zárate affirmed that constitutional inclusion is essential for the state’s citizenship to accurately reflect its social and migratory reality. “These individuals are active members of our community due to their origins, family ties, and ongoing participation in the cultural, social, and economic life of their ancestral communities,” he emphasized.
She also emphasized that recognizing them as Oaxacans not only avoids restrictive interpretations of the constitutional text, but also strengthens social justice and the historical continuity of the people of Oaxaca, reaffirming the inclusive and pluralistic nature of the local Constitution.
This proposal aligns with the resolution approved by the Senate of the Republic on December 9, 2025, which urged the federal entities to adapt their legal frameworks to recognize the legal identity of children of Mexicans born abroad.
Therefore, the initiative seeks to provide greater clarity and normative coherence to the local constitutional text, harmonizing it with the Federal Constitution and with the legislative criteria that recognize the migratory reality of the country and the state.
The initiative, presented at the Ordinary Session of January 13 of this year, was referred by the Board of Directors to the Standing Committee on Constitutional Studies for its review and opinion.
