By decree, SEMARNAT delivers beach property to Huatulco

Land of 589.16 square meters in Playa Pescadores will only have recreational use; fishermen have been affected by the sale of properties to individuals

Through a decree that was published in the Official Gazette of the Federation on Monday, May 23, and entered into force on Wednesday, May 24, the Ministry of the Environment and Natural Resources (SEMARNAT) allocated a property in the federal maritime land zone to the municipality of Santa María Huatulco that will be used for recreational use, sports and cultural events, without authorization to carry out any work or installation.

It is a property of 589.16 square meters located in Paseo Santa Cruz; in Bahía Santa Cruz, which is part of the federal maritime-terrestrial zone; it is a portion of Playa Pescadores.

This property was requested by the municipality of Santa María Huatulco through an official letter dated May 4, 2018; signed by the current mayor José Hernández Cárdenas.

Five years later, on May 3, 2023, the Ministry of the Environment and Natural Resources headed by María Luisa Albores González, assigned the property, the decree that was published in the Official Gazette of the Federation on Monday, May 23.

It should be noted that said agreement grants the municipality of Santa María Huatulco the right to use the property for recreational use, sports and cultural events, without authorization to carry out any work or installation, does not transfer ownership or create any real right in favor of the recipient.

In addition, that at any time, SEMARNAT may again delimit the federal maritime-land zone and the intended polygon may be modified.

In the event that the municipality of Santa María Huatulco gives the surface of the federal maritime land zone that is destined, a use other than that provided for in the Agreement, without the prior authorization of the Ministry of Environment and Natural Resources, or stops using it or needing it said property with all its improvements and accessions will be withdrawn from its service to be administered by a federal agency.

The municipal government headed by José Hernández Cárdenas reported that the portion of land in Playa Pescadores will be for recreational use, sporting and cultural events for the enjoyment of visitors and locals; which must be previously authorized by the municipal agency of Santa Cruz, Huatulco.

On the subject, the municipal government invites users to respect current regulations because “the beaches of Huatulco are fragile ecosystems where a diversity of flora and fauna lives.”

It transcends that, for next June 5, World Environment Day, the head of SEMARNAT, María Luisa Albores González will visit Bahías de Huatulco where more information will be released on the use of the property assigned by said agency to the government of Santa Maria Huatulco.

Pescadores is a beach located near the hotel zone of Bahías de Huatulco; It is one of the virgin beaches of the tourist complex and is used by fishermen and locals.

At the beginning of 2022, the access to the Pescadores beach, which has been used by fishermen and locals for many years, was moved to a more complicated path to travel, which directly affected producers to safely transport their tools and products obtained from sea.

Properties located in Tangolunda were sold by the National Fund for the Promotion of Tourism (FONATUR); Access to Pescadores beach is located on the property sold to the La Recoleta hotel project since 2008.

In 2022, access to Pescadores was closed and users could no longer enter; They had to find another way, a trail that was further away and made it difficult for them to transport their fishing tools, sometimes motors and boats; in addition to the product of the catch of the day.

Of the announced hotel project, nothing was built; Fishermen believe that the land was resold and that they are marketing it in residential lots that cover areas of what may be the federal maritime-terrestrial zone.
